Terms and Conditions for Individual and Organisational Members

Effective from: 8th June 2025


1. Overview

These Terms and Conditions ("Terms") govern your access to Empower: The Library Skills Collective ("Empower"), operated by Helen Rimmer trading as The Kind Brave Leader ("we", "us", or "our"). By joining Empower as an individual or on behalf of an organisation, you agree to be bound by these Terms.


2. Definitions

Individual Member: A person who purchases membership for their own professional use.

Organisation: A business, library service, school, university, or other entity purchasing access for team members.

Seat: An individual user access under an organisational membership.

Platform: The Empower website, learning portal (Moodle), community area, and all associated tools and resources.

Subscription: A monthly or annual payment providing access to Empower services.


3. Membership Access

3.1 Individual Membership

Membership includes access to live webinars, on-demand content, community groups, toolkits, and CPD resources.Your membership is personal and non-transferable.Once payment is confirmed, access is granted immediately.

No refunds are provided, including in cases where your organisation subsequently purchases a group plan.


3.2 Organisational Membership

Access is granted via a seat-based model. Each seat is for one named individual.

Seats may be reassigned within your organisation by contacting us.

Sharing of login credentials is not permitted. We reserve the right to suspend accounts where misuse is suspected.

Organisations are responsible for maintaining an accurate list of seat holders and notifying us of changes.


4. Fees and Payment

All membership fees are payable in advance, either monthly or annually.

Prices are as published on https://empowerlibraryskills.com/pricing and may be updated annually with at least 30 days' notice.

Non-payment may result in access suspension without notice.

All prices are inclusive of VAT where applicable.

4.1 Late Payment
If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at a rate of

4% per annum above the Bank of England base rate, accruing daily until payment is made in full. We may also charge a

reasonable administrative fee for repeated payment reminders.

In the case of persistent non-payment, access to the Empower platform may be suspended without further notice until outstanding balances are cleared.


5. Cancellations and Refunds

Empower is a digital membership service. By purchasing, you consent to immediate access.

As such, no refunds will be given after purchase, except as required by law.

Individual members may cancel anytime and retain access until the end of the billing period.

Organisational memberships require written notice of cancellation at least 30 days before renewal. No pro-rata refunds are given.

If a current individual member is later covered under an organisation's subscription, no refund will be issued.


6. Content and Usage

All materials provided through Empower—including videos, PDFs, workbooks, and toolkits—are for your personal or internal organisational use only.

You may not download, distribute, or share content outside the scope of your membership.Intellectual property remains with Empower or contributing trainers. No commercial use is permitted without express written consent.


7. Member Conduct

All members agree to:

Treat others in the community and training spaces with kindness, respect, and professionalism.

Not share login details or copyrighted content.

Not misuse the platform for spamming, harassment, or promotion of services not affiliated with Empower.


8. Platform Access and Downtime

We aim to provide uninterrupted access but may occasionally need to update, maintain, or improve systems.

We reserve the right to modify or remove content at any time.

In the unlikely event of downtime exceeding 30 consecutive days, organisational members may request a pro-rata refund for the lost access period.


9. Data Protection

We handle personal data in accordance with our Privacy Policy https://empowerlibraryskills.com/privacy-policy.

Organisational clients are responsible for ensuring they have appropriate consent to provide staff details to us.


10. Termination of Access

We reserve the right to suspend or cancel access without refund if:

A member violates these terms.

An organisation fails to pay as agreed.

Behaviour is deemed to be harmful to others or to the integrity of the community.


11. Liability

We are not liable for indirect losses, including loss of business, time, or opportunities.

Our total liability under these Terms is limited to the total fees paid by you in the past 12 months.

Nothing in these Terms limits our liability for death, personal injury, or fraud.


12. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the English courts.
